Parliament Passes Bill To Prevent Leaks of Sensitive Government Information

During a historic session on Monday, November 20, 2023, the Honorable Garth Wilkin, Attorney-General and Minister of Justice and Legal Affairs, successfully steered the debate on the Unauthorized Disclosure of Official Information Bill, 2023. This legislation, aimed at curbing the leakage of sensitive government data, received parliamentary approval after thorough deliberation.

At its core, the Bill confronts a pressing concern within the civil service—the unauthorized divulgence of confidential government information. It delineates explicit guidelines for government staff and contracted workers regarding the management of sensitive data, prohibiting its storage in personal email accounts or unauthorized disclosure outside official information channels.

Attorney-General Wilkin articulated the significance of the Bill, stating, “This legislation signifies a crucial stride in upholding our government’s integrity. Candidly, Madame Speaker, a culture has emerged within our civil service that lacks regard for safeguarding sensitive government information and documents.”

The Unauthorized Disclosure of Official Information Bill, 2023, complements the existing Freedom of Information Act. While the latter grants public access to non-sensitive government data, the new Bill fortifies protections for confidential, privileged, and sensitive information, preventing unauthorized leaks.

AG Wilkin emphasized that safeguarding sensitive government data aligns not just with local standards but also with global practices. The legislation positions St. Kitts and Nevis in alignment with international norms for securing vital state information.

The passage of this Bill signifies a significant stride by the government of St. Kitts and Nevis in bolstering the legal framework governing the security and integrity of official information. It signifies a pivotal moment in the nation’s continuous endeavor to fortify its governance mechanisms.
