Section 64 of the Constitution provides that the Honourable Attorney General is the Principal Legal Advisor of the Government of Saint Christopher and Nevis. As such the Attorney General’sChambers plays a pivotal role in the administration of justice and the maintenance of the rule of law in the Federation.
The duties and responsibilities that lie within the remit of the Chambers are many and therefore must be properly financed. These functions are outlined in the Attorney General’s Act and include:
• ensuring that the administration of public affairs is in accordance with the Constitution and the law;
• supervising all matters connected with the administration of justice;
• being responsible for advising on the Legislative Acts and generally advise government on all matters of law referred to the Attorney General’s Chambers;
• advising the Government upon all matters of a legislative nature and superintending all Government measures of a legislative nature;
• advising the heads of the Government Ministries and Agencies of Government upon all matters of law connected with such Ministries and Agencies;
• conducting and regulating all litigation for and against the Crown or any Ministry or Agency of Government;
• performing such other functions as may be assigned to him by the Governor General, acting in accordance with the advice of the Prime Minister.
The Attorney General Chambers functions as a legal chamber similiar to the offices of a private law firm. The technical administrative person is the Solicitor General.who works under the guidance of the Attorney General. They supervise and manage the legal team within the department. The administraive staff handles the clerical and paralegal functions.
The Office of the Attorney General remains cognizant of its role as gatekeeper in upholding the tenets of transparency, accountability and the rational application of the laws. Having been thusstrategically poised at the vanguard of the meaningful functioning of Government, the efficientrunning of the Chambers undoubtedly requires the necessary fiscal support. Although on the faceof it the budget is about dollars and cents, however, this actually translates into the wherewithal for meeting the multifaceted demands of Government in particular and the Nation as a whole.
